So I did my 90 day duty from 10/16/2011 to 1/14/2012. I met all requirements and ready to attest. Well....denied! I guess the 90 day reporting period has to be in the same year? Did everyone know this or am I wrong?

Now I have to start all over to get 90 days in 2012 and not real happy about it.

Dr. Christian, I am sorry that you learned this the hard way. This 90 day reporting rule has been well publicized by the Center for Medicare/Medicaid Services office. CMS allows the first calendar year of reporting to consist of only 90 days. However the 90 days must be WITHIN the calendar year of reporting, hence all 90 days of attestation would be for 2011. This is why you were denied.

If you re-run a report in AC for the dates 10/3/11 (the latest date in 2011 CMS announced they will accept the 90 day reporting) through 12/31/11 and your data still passes the minimum requirements, you could possibly re-attest. HOWEVER, this depends upon how far you got on the CMS webpage when you attested. If you clicked on the final submission button at the very end of the long attestation series of webpages, you will have to start anew for 2012.

Look at the post I placed under Meaningful Use earlier this morning. It contains a link for the Regional Extension Centers by state. You may be well served to get in touch with them to help ensure you meet the goals.

Thanks Adam. I did not fully attest once I realized the issue. I ran the report from Oct3-Dec31, but did not meet the core clinical summaries requirement as I was printing them, but not realizing they were not saving (if I did not immediately sign my note) until too late, that is why I had to do 2 extra weeks in January.

Well I am now 15 days into a new 90 days. I guess I will attest in March.

I've been in regular communication with the State of Maine REC. They were exceedingly helpful to me and I could not have attested successfully without their guidance. In Maine, they have a small federal grant and provide services to small practices at no cost. Our REC Director told me that not all states provide free service, and the level of support is different for each state. However I'm glad you are going to inquire and find out what levels of support you qualify for.
