Chris, Where are you exactly in "Upstate" NY? We are in Liverpool, just north of Syracuse where Cascade LAX and Hockey Helmets are Proudly Made in the USA and NYS!!! Custom Order in 48 hours too. M11 and M11 Pro are the two best hockey brain buckets on the market, greatly increasing a player's odds of not sustaining a concussion or at least not as nasty one as it would have been in a traditional, foam on shell helmet design, transfering about half as many G's to the head of the player... Yeah that good!
Anyway, here in CNY I beleive the HE is up and running but might still be on the health exchanges side of the things that only larger test groups and hospital affliated groups got in first. I'm sort of weak on this but I thought in the Admin section was the required HE hook-up for us to activate if we so desired to do so? NOW we do NOT Desire to do so for many important, patient oriented, Civil Rights concerning reasons. But if you want to, you should be able to if your regions, HE is up and running already to take all comers....
BUT, I might Warn ALL OF YOU out there, making a mad, blind dash to level 1 and 2 Meaningless Use, that I was just reading an article in the American Medical News that about 65% of patients have strong concerns about the use and misuse, over accessability of their PHI in this Big Brother, Brave New World, CMS, the Congress and our President have created and overly bought in to. Personally, we here at our place we are only doing direct, one way links, we down load results and the like, we don't upload demographics and nobody has any sort of HIE connection to and from our little server here at our place.
I have been researching Canada a bit and although they too are sort of starting to Run to this model a bit more than I would care for, at least they are talking about privacy for real and making that one of the MAIN Mission Statements, requirements of any system that they create. What I would like to see is something much more like a modern conversion of data to and from various vendors systems so we can all exchange notes and results, images and the like, but in a much more "Direct" office to office, doctor to doctor kind of way, the way we do presently for years with Fax machines. Create a unique NPI like number for each doctor, have the data reside only temporarily in some email like storage holding facility, for the recieving doc to download other docs results and notes, and like we do with AC right now with labs and the like, if there is a problem between our system and the other guys, AC, the EMR will flag in and allow us to see who it is and properly assign it to the correct patient's file, chart.
But this still allows for the much safer, much more privacy protecting, nobody gets in without our say so, they only get what "WE" the providers' offices decide is appropriate to share and or send and to WHO... Who is a valid provider, who is allowed to know certain and different parts of any given "Citizen's" medical records and who MIGHT NOT be so entitled or Need to Know might we say....
So before you and anybody else here goes running to put their servers directly connected to the Medical Version of the ever invasive Information super highway, I might start engaging your patients, fellow American Citizens All, and ask them if they feel it is proper, ethical, legal, constitutional to allow any and all federal and state gov't agencies and all insurance carriers to have pretty much full time, unfetered access to their medical charts and other related PHI.... I bet a good number of them once they get the real drift of things here, and actually understand the real impact and truck sized holes in the thing, will think twice and most will Balk at the idea once properly informed.
Heck I was Inappropriately THREATENED by my OWN GI's office affiliated with one of the larger hospitals here St Joe's that they "Might not be able to move forward with treatment in an emergency if they could not access my files and any and all of the health information on the new HIE here in our area" I went Balistic on the lady, getting in her face about falsely threatening my right to fast and necessary treatment based upon my desire to protect myself from the almost right on top of us Orwellian Big Brother HIE... I mean what have doctors and ER's done for the past few hundred years in the abscence of perfect (and yet one should never fully trust and take them as stone tablets, Someone else's notes and med list anyway, RIGHT????) instant electronic access to any and all potential, past and present providers' notes and the like. They proceeded appropriately and took one or two precautions in the process while dealing with an emerging problem...
This entire exchange thing is so bogus and not safe or IMHO Constitutional except with the bullied and lied to the patients about HIE's and Vaccine Registries and the like. When my parents first starting writing checks and charging things with Master Card in the 1960-'70's I don't believe they would have ever envisioned a day (as ACLU Members No Less) when a "Potential" not even yet your actual legal employer or record, would be allowed full and free access to their credit history, no less the right to make use of what was in that credit history as a reason to or to NOT hire any given natural citizen of our nation. So don't tell me that our PHI and and that these HIE will never be used for other purposes and by those that shouldn't have ever been given access no less the right to use and abuse what they find in there one day....
Ask your patients what the would prefer you as a doctor do, lock down your incoming and outgoing ports for such things on your firewall router, to properly protect them and their fellow patients from any potential access, or to put them all too easily and exposed for all to access and see on these "Modern Wonders" HIE's..... I would be real interested to see and hear the feedback and responses, yes or no.....

Patriot Act Destroyed almost all protections against gov't invasions of PHI, and ripped a HUGH hole right upside the thing, making it almost meaning the opposite of what most people thought it was supposed to mean and do for them. Yes we docs are on the hook for HIPAA like problems, but the gov't is pretty much free to come and go as they please without even advanced notice to doc or patient. It is even illegal for a doc to inform, warn a patient that the gov't has gone thru or requested copies of their files... Nice right?)

Paul! I agree with much of your "rant" However, most, if not all, of our patients who have medical insurance, have, in fact, signed away their rights to that kind of privacy. Insurance companies have "permission" to inspect patient charts for many reasons, all of their private information hanging out to be seen. See my post a few minutes ago in AC problems regarding HIEs.
