This report came today in my "American Osteopathic Association Daily Report 12/21/10." This is a daily email publication by the AOA. I thought you should all know what they are reporting about Medicare rules if you didn't already know this about E-Rx'ing. New Payment Policies Related to E-Prescribing All DOs should be aware that they may face a payment penalty in 2012 and 2013 under Medicare rules if they are not e-prescribers in 2011, regardless of participation in the e-Rx Incentive Program. The 2012 penalty will be determined by e-prescribing activity during the reporting period from 1/1/11 to 6/30/11, and the 2013 penalty will be determined by e-prescribing activity for the entire 2011 calendar year. The Medicare fee schedule payment for services provided by physicians or group practices that are not successful e-prescribers will be reduced by 1% in 2012 and by 1.5% in 2013. The AOA and other physician organizations are calling on CMS to revise its policy on e-prescribing activity and strongly oppose basing the 2012 and 2013 e-prescribing penalties on e-prescribing activity that occurs during 2011.

Although this notification was just sent yesterday, they threat of penalty has been out there for quite some time. Every lecture I've attended about changes in medicare over the past few years have talked about these penalties and the dates they will take effect.

I have been hearing about this for a long time too. We get such a large volume of information about the "incentives" that this often gets lost. I would bet that most docs do not realize that if they don't e-prescribe in 2011, then they will be penalized in 2012 and 2013, apparently regardless of what they do in those years!

The medicare language states physicians "MAY" face a penalty in 2012 and 2013. In a climate where Medicare is facing the threat of nearly 25% cuts to which Congress has only applied Band-Aids, I am operating under the assumption that "MAY" can be interpretted as "WILL." Perhaps they won't actually apply the cuts to physicians that are not E-Rx'ing in 2011 (for 2012 & 2013) but I don't want to take that gamble.
I feel so fortunate that A.C. has made the E-Rx'ing module. In the 2 weeks that we've been using it, we have satisfied our 25 Mecicare patient quota and more. Our patients are loving it, my staff are loving it, I am loving it, and I will love the 2% bonus check next year. Thanks to A.C. for making this option possible for us!!!!

Adam, not to quibble, but this is from CMS: "Adjustment Amounts With respect to covered professional services furnished by an eligible professional during 2012 or any subsequent year, if the eligible professional is not a successful E-Prescriber for the reporting period for the year, the fee schedule amount for such services furnished by such professional during the year shall be reduced by: ? 1.0 percent for 2012, ? 1.5 percent for 2013, and ? 2.0 percent for 2014 and each subsequent year".
I agree entirely with your praise for AC's e-rx module!
