Personally I work on the assumption that if the patient wants the spouse/sibling/parent/friend in the room, then that is specific approval to divulge the PHI to that person as I speak with the patient. If I have any doubt, of course, I ask first.
If the patient is not present, and I have not gotten persmission from the patient, I pull a Sgt Schutz: "I know nothing!!!"
