I would just stick with version 9 and boycott version 10 altogether. If physicians refuse to be bullied, this type of stuff will stop. Alternatively, you can buy Microsoft's voice dictation... so far, Microsoft doesn't seem to do such stuff, which is probably why they are such a beheamoth: they simply treat their customers well.
It probably is "legal", since they are only singling out the names of well-known EMRs. It's just a low road that they are taking.
